DECISION OF THE BOARD OF DIRECTORS

Having considered the Motion for Interlocutory Appeal and the Response thereto, the Board denies the motion. The motion was not presented to the Hearing Officer in the first instance, as required by the Board’s rules. See Rule § 7 .13 of the Procedural Rules of the Office of Compliance. Accordingly, the Board also dismisses the Motion to Strike the Motion for Interlocutory Appeal as moot.
