DECISION OF THE BOARD OF DIRECTORS

The Hearing Officer issued an Order in the above-captioned case. The Hearing Officer found Derrick Macon’s (“Macon”) claims untimely. Further, the Hearing Officer found that Macon failed to state a claim for which relief may be granted. The Hearing Officer granted the USCP’ s motion to dismiss.

The Board has considered the Hearing Officer’s Order in light of the record, the petition for review, and the parties’ briefs and filings. The Board finds that the Hearing Officer’s conclusions are supported by substantial evidence and affirms the Hearing Officer’s determination that Macon’s claims are untimely and that Macon failed to state a claim for which relief may be granted. See Pollack v. The Office of Congresswoman Ileana Ros-Lehtinen, 15-HS-34 (CV, DA, RP) (May 11, 2016). We rely upon the Hearing Officer’s finding and conclusion that Macon failed to show that his claims are timely. Further, we agree with the Hearing Officer that Macon’s claims should also be dismissed because Macon failed to state a claim for which relief may be granted.

ORDER

For the foregoing reasons, the Board affirms Hearing Officer’s Decision to dismiss all claims.
