ORDER DENYING REQUEST FOR SUA SPONTE REVIEW

On June 25, 2007, Hearing Officer Sylvia Bacon issued a written order, dated June 22, 2007, nunc pro tunc June 19, 2007, requiring the parties to attend a mediation session scheduled for June 28, 2007. On June 26, 2007, the Respondent filed a request for interlocutory review and a stay of proceedings. Hearing Officer Bacon denied the request on June 27, 2007. On June 28, 2007, the Respondent submitted a letter to the Office of Compliance, requesting the Board of Directors to review, sua sponte, the June 22, 2007 order of the hearing officer.

Section 7.13(g) of the Office of Compliance Procedural Rules states that the Board of Directors may sua sponte review the denial of a party’s request for interlocutory review if, after consideration of the motion for interlocutory review and consideration of the reasons for denial, the Board believes that review is warranted.

Pursuant to § 7.13(g) of the Office of Compliance Procedural Rules, the Board finds that, upon consideration of the motion for interlocutory review and upon consideration of the hearing officer’s reasons for denial of the motion, interlocutory review of the issues raised by Respondent is not warranted.

It is so ORDERED.
